Lalu Yadav jailed for five years, A complete story

Ground Report | New Delhi: Lalu Yadav jailed; Former Bihar Chief Minister and Rashtriya Janata Dal chief Lalu Prasad Yadav has been sentenced to five years imprisonment by a special CBI court in Jharkhand in the fifth fodder scam case. A fine of 60 lakhs has also been imposed on him.

Lalu Yadav's lawyer says that he will appeal against the sentence in the High Court. This was the last and fifth case of Jharkhand fodder and animal husbandry scam. On February 15, the court had convicted Lalu Yadav in this case.

Lalu Yadav has spent a total of eight months in jail and 31 months in hospital since his conviction in 2017 in other cases of fodder and animal husbandry scam. For eight months, Birsa Munda has been in the Hotwar jail in Ranchi. He is out on bail now.

Lalu Yadav's lawyer Prabhat Kumar from Times of India has said, "Lalu Yadav was shifted to Rajendra Institute of Medical Science ie RIMS, Ranchi on August 30, 2018 and stayed till February 13, 2021. Later he was shifted to AIIMS in Delhi.

In the famous multi-crore animal husbandry scam of the nineties, the CBI had registered a total of 66 cases then. In six of these cases, the then Chief Minister of Bihar, Lalu Prasad Yadav was also made an accused. After the bifurcation of Bihar, five of these cases were transferred to Jharkhand.

Convicted in four of these five cases

Lalu Yadav has already been convicted in four of these five cases. However, he was granted bail in these cases. RC 47-A/96 was the fifth and final case. There are allegations of illegal withdrawal on fake bills between the years 1990-91 and 1995-96.

This is also the biggest withdrawal case in terms of withdrawal of money. In this, charges were framed against Lalu Prasad Yadav under Section 120-B of the IPC and Sections 13(2) RW 13(1) (c), (d) of the Prevention of Corruption Act, 1998.

He was accused that he did not take any action in this matter while being the Chief Minister. Several MLAs and MPs raised the issue in the Legislative Council and Lok Sabha respectively, saying that there were malpractices in the Animal Husbandry Department and illegal clearance was being done through fake bills.

After the expose of the scam in the year 1996, its FIR (No. 60/96) was registered on February 17 at Doranda police station of the then Bihar. Of these, 55 accused died during the trial itself. Eight other accused became government witnesses (approvers) as per the provisions of CrPC (Code of Criminal Procedure 1973). Two of the accused had already accepted the guilt.

However, Bihar CM Nitish Kumar and BJP leader Sushil Modi have reacted to Lalu Yadav being sentenced to five years in a fodder scam case. Nitish Kumar has said that he did not file a case against Lalu Yadav. In a conversation with journalists, Nitish Kumar said- We have not registered a case against him. Those who are with him, these are the same people who have filed cases against him. Those people also came to me, but I said - no. I said if you want to file a case, you can. But this is not my job.

On the other hand, Nitish was the Deputy Chief Minister in the government for a long time and now BJP's Rajya Sabha MP Sushil Modi expressed happiness over the conviction of Lalu Yadav. Now Sushil Modi says that no one is surprised by Lalu Yadav's five-year sentence and a fine of 60 lakhs. He wrote on Twitter – This had to happen. Laluji's charge sheet was done at the time of Deve Gowda ji and the first punishment was done during Manmohan Singh ji. Still, the same melody that was trapped will be recited.
