Nowadays, Indian people are immersed only in technology and its high-tech equipment. They play online casinos in India at a lower cost than the physical casino setup.

The growing pandemic situation of the country has made many Indians dependent on the game of gambling. They have started waiting for the prize money of gambling to meet their social and financial needs. Such practices have led to an increase in money laundering and black money sources in India.

Betting and gambling can be found in Part II of the State List. They are mentioned in detail in the Seventh Schedule of the Indian Constitution. In other words, it simply means that the state government can exert complete control over the betting and gambling practices in its state. They can also make their own state-specific laws. A good example of this is the option given to most of the states to adopt the Public Gambling Act, 1976.

Is gambling considered a game of chance or a game of skill in India?

India mainly puts sports into two broad categories to separate them. There are two categories sport is either a game of chance or a game of skill.

Games of chance: Games of chance are all those games that are played at random. These games are based on luck. A person can play these games without any prior knowledge or understanding. For example, playing dice, choosing numbers, etc. Such games are considered illegal in India.

Games of Skill: Games of skill are all those games that are played on the basis of a person's prior knowledge or experience of the game. A person will need skills like analytical decision-making, logical thinking, ability, etc. Some initial training may also be required to win some awesome Such games legal by most Indian states.

Also, if the game of gambling requires a certain amount of skill, it may not be considered illegal at all. However, a lot of prejudice revolves around such gambling games.

What is the legal status of gambling in India right now?

Horse racing and lotteries are legal in India. Horse racing involves certain prerequisite skills, so it's not just about gambling. Many Indian states have legalized lotteries. These are Goa, Kerala, Arunachal Pradesh, Assam, Maharashtra, Madhya Pradesh, Mizoram, Manipur, Meghalaya, Punjab, Nagaland, West Bengal and Sikkim.

Online gambling and land-based casinos were legalized in Goa, Sikkim, Nagaland and Daman under the Public Gambling Act 1976. Maharashtra banned gambling and made it illegal under the Bombay Prevention of Gambling Act, 1887.

Electronic gambling (gambling) has been legalized in Sikkim and Nagaland. Telangana and Arunachal Pradesh make games of skill illegal under the Telangana State Gaming Act, 1974. All India Gaming Federation, The Rummy Federation and Federation of Indian Fantasy Sports have adopted an automated code for all their advertisements.

Conclusion: The legal status of gambling in India in 2021 requires revamping various gambling laws that are more uniform. The government needs to step up its game by installing a proper legal framework.
