NGT orders removal of mobile signal tower in Karol Bagh green area

The National Green Tribunal (NGT) has issued a directive to M/s Indus Tower Pvt Ltd to dismantle and remove the construction and civil works carried out for the installation of a mobile signal tower on a green area in Karol Bagh, New Delhi.

The decision comes after the NGT addressed the complaint about the validity of the permission granted by the Municipal Corporation of Delhi (MCD) to install the tower.

The controversy arose from the installation of the mobile signal tower at Seth Ghanshayam Dass Chowk, Ramjas Road, inside a park in the bustling Karol Bagh area. The applicant raised concerns about the legitimacy of the permission granted by the MCD to M/s Indus Tower Pvt Ltd for the facility.

In response to NGT's notices, the Delhi Municipal Corporation stated that the permit granted to M/s Indus Tower Pvt Ltd had been revoked on 18 April 2023 with immediate effect. However, certain constructions and civil works have already been carried out by the proponent of the project, which led the applicant to demand corrective measures.

Considering that the constructions were carried out with the approval of the MCD, the NGT ordered the proponent of the project, M/s Indus Tower Pvt Ltd, to restore the green area to its original state. If they fail to do so, the responsibility will pass to the Delhi Municipal Corporation, which will have to restore the area at the expense of the project proponent.

The NGT ruling emphasizes the importance of protecting green spaces and ensuring compliance with regulatory approvals. It also serves as a reminder for project proponents and municipal authorities to exercise due diligence and adhere to environmental guidelines when undertaking infrastructure developments.

With this decision, the NGT has brought the matter to an end, ordering immediate action to restore the sanctity of the green area at Karol Bagh. The restoration process is expected to start shortly, ensuring that the park returns to its original nature for the benefit of the local community and the environment.
