The National Green Tribunal, Central Zone Bench, has issued notices to approximately 13 restaurants in Bhopal for alleged violations of environmental norms. The state of Madhya Pradesh, the Municipal Corporation of Bhopal, and the Madhya Pradesh Pollution Control Board have also been notified.
Despite numerous letters and requests to the restaurants and the municipal commissioner, no action has been taken. As a result, the court has ordered the municipal commissioner of Bhopal to provide an explanation for the lack of action based on the reports submitted by the state pollution control board.
Bhopal restaurants face legal action
The applicant has pointed out that these establishments are in violation of guideline no 3.4 of the Guidelines for Compliances of Environmental Norms by road eateries, restaurants, and other establishments issued by the Central Pollution Control Board (CPCB). This guideline states that every roadside eatery, restaurant, and establishment requires consent to establish and operate their restaurants from the concerned State Pollution Control Board.
The court noted that the restaurants and the municipal commissioner had received multiple letters and requests but had not taken any action. Consequently, the court ordered the municipal commissioner of Bhopal to explain why he had not acted upon the reports the state pollution control board submitted. Also, the court questioned the authority that allowed these restaurants to operate without the necessary consent.
The applicant has pointed out a violation of guideline no. 3.4 of the Guidelines for Compliances of Environmental Norms by road eateries, restaurants, and other establishments issued by the Central Pollution Control Board. This guideline states that every roadside eatery, restaurant, and establishment must obtain consent from the relevant State Pollution Control Board to establish and operate their restaurants.
The restaurants in question are operating without the required Consent to Establish (CTE) or Consent to Operate (CTO) from the appropriate statutory authorities. They are using coal and wood for their tandoor without proper ducting/hood arrangements and exhaust systems. Additionally, they are violating the Solid Waste Management Rules of 2016 by disposing of unprocessed solid waste in the open and discharging untreated effluent directly into the sewer.

The following restaurants have been implicated in these violations:
- KMC
- Nice Restaurant
- Ba-Dastor
- Sigdi
- The Nayab
- The Golden Biryani
- Zam Zam
- Zaika
- The Munch Box
- Balveer da Dhaba
- Dada ji Hotel
- The Osman
These establishments are all located on the 80 ft. Main Road, Ashoka Garden, Bhopal. The respondents have been given four weeks to respond to these allegations.
