“You as a state have to uphold the rule of law”: Supreme Court on Vikas Dubey Encounter

While hearing petitions for court monitoring of encounter of Vikas Dubey and his associates, the Supreme Court on Monday, expressed concern over the law and order situation in the state. “You as a state have to uphold the rule of law. It is your duty to do so”, the Supreme Court told the UP government.

The bench headed by Chief Justice SA Bobde was hearing a batch of pleas seeking CBI or NIA probe into the encounter and the killing of the 8 policemen.

“We are appalled to the fact that a person like Vikas Dubey was out on bail, despite so many cases. This is a failure of an institution where he was released on bail and did this. We need a report on such bail orders”, the bench said.

The Chief Justice, SA Bobde even asked the Uttar Pradesh government lawyer to consider the statements of the Chief Minister and Deputy Chief Minister if it had anything to do with the incident.

The encounter took place on the morning of 10th July at the outskirts of Kanpur. As the police were bringing him back from Ujjain to Kanpur, the car carrying Dubey met with an accident. It is then that he was shot dead after he tried to escape. Before Dubey, 5 of his associates were killed in separate encounters.

The encounter of gangster Vikas Dubey raised many questions around the UP Police, the government and its functioning. The People’s Union for Civil Liberties (PUCL) had also filed an application to look into the increase in encounters in Uttar Pradesh since 2018.

The Supreme Court while hearing the plea said: “What is at stake is not one incident in UP, but the whole system”. The bench then asked the Uttar Pradesh government to form an inquiry committee that has a former apex court judge along with a retired police officer. The court will now hear the case next Wednesday.
