Not seditious to have views different from govt; SC dismisses petition against Farooq Abdullah

The Supreme Court on Wednesday dismissed a petition seeking action against former Jammu and Kashmir Chief Minister Farooq Abdullah for his remarks regarding Article 370.

On the plea seeking the prosecution of treason, the Supreme Court said that it is not treason to have a separate view from the government.

A bench of Justices Sanjay Kishan Kaul and Hemant Gupta ruled. Refusing to consider the plea against Farooq Abdullah, the bench said that the expression of views other than the opinion of the government cannot be termed as traitor. The bench has also imposed a fine of Rs 50,000 on the petitioner.

Rajat Sharma and Neh Srivastava had filed a petition in the Supreme Court seeking order to carry out treason proceedings against Farooq Abdullah for making a statement against Article 370 in Jammu and Kashmir. The petition also demanded that the leader's membership of Parliament be declared invalid and he be charged with treason under Section 124-A of the IPC.

Farooq Abdullah, the leader of the National Conference and former Chief Minister of Jammu and Kashmir, made a disputed statement about Article 370, in which he said that China can get help in the resumption of Article 370 in Jammu and Kashmir.

 Along with this, he described those who supported this move of Modi government as traitors. 

Farooq Abdullah said in a conversation with India Today, 'As far as China is concerned, I have never called the President of China here. 

Our Wazir-e-Azam (Prime Minister) called him in Gujarat, made him sit on the swing, took him to Chennai as well, fed him a lot there, but he did not like it and he told Article 370 that we should confess Is not. And until you restore article 370, we are not going to stop, Because you have now got this open matter. May Allah help our people with this thrust and Articles 370 and 35A be restored. '

It is worth mentioning that on 5 July 2019, the Modi government had neutralized most of the provisions of Article 370 giving special status to Jammu and Kashmir. 

It was opposed by Pakistan and its partner China. However, India warned him not to interfere in the country's internal affairs.
