Keeping Priyanka in custody illegal, no rule of law in UP: P Chidambaram

Ground Report | New Delhi: Keeping Priyanka in custody illegal; Senior Congress leader P Chidambaram has termed the detention of Congress General Secretary Priyanka Gandhi as illegal.

In a statement, P Chidambaram said that his detention has completely proved that there is no rule of law in Uttar Pradesh.

Accusing the Uttar Pradesh Police, he said that from the recent developments it seems that the state police is following the law of Yogi Adityanath and only his orders.

Priyanka Gandhi was detained in Sitapur on her way to Lakhimpur Kheri. Where eight people died in a violent incident on Sunday. Four farmers were among the eight who died in Sunday's violent incident, who were allegedly crushed to death by vehicles. (Keeping Priyanka in custody illegal)

It is being claimed that the others killed were BJP workers and their drivers.

P Chidambaram said, "The facts and circumstances relating to the detention of Priyanka Gandhi in Sitapur prove that there is no rule of law in UP."

He said, "He was 'detained' on Monday, October 4 at 4.30 am. He has been kept in custody at the PAC Guest House in Sitapur. Both the concerned District Collector and the Judicial Magistrate are posted in Sitapur. He is to be detained. Totally illegal and an abuse of power."

Chidambaram further said, "The police officer who took him into custody told that he has been detained under section 151 of CrPC. But no person detained under S151 has been detained for more than 24 hours. unless ordered by a Judicial Magistrate under any other provision of law."

He said that he is in custody for more than 30 hours and he has not been produced before a judicial magistrate.

"There is no order of any judicial magistrate. Their constitutional rights under Articles 19 and 21 have been grossly violated. Their detention is in violation of several provisions of CrPC," he said.

Chidambaram cited facts of law that no woman can be detained after sunset or before sunrise and Priyanka Gandhi was detained at 4.30 am, which is "illegal".

He alleged, "Law and order in UP means the law and order of Yogi Adityanath. Where the police is also following his orders."
