Ishrat Jahan's mother will challenge release of accused in encounter case

On Wednesday, the special CBI court acquitted the last three accused in the Ishrat Jahan encounter case near Ahmedabad on 15 June 2004.

Ishrat Jahan's mother Shamim Kausar will challenge this decision in court. Shamima Kausar's lawyer Vrinda Grover said.

On Wednesday, Special CBI court judge VR Rawal ordered the release of three Gujarat Police officers GL Singhal, Tarun Barot and Anju Chaudhary.

The Gujarat government did not allow the CBI to prosecute these three accused, after which three, including retired police officer Tarun Barot, submitted a discharge application.

After this, the court acquitted his plea and acquitted him in this case. Now there is no accused in this case, after which there will be no further trial in it.

Ishrat Jahan's mother Shamim Kausar's lawyer Vrinda Grover said that the CBI court order is a violation of the Supreme Court's prescribed law to get permission before a fake encounter and trial.

Grover said, "As per Section 197 of the CrPC, the legal protection of obtaining permission before starting a case against a government servant does not apply in this case as it was found after a rigorous investigation by the CBI that it was a hatched encounter.

The deceased Ishrat was abducted, illegally detained for two days and then killed. The witnesses and the forensic and scientific evidence that the CBI has gathered corroborate it."

"Bypassing all the evidence in the record, the CBI court has been reposed on what the Gujarat government has presented to its details. From the beginning till the end, the Gujarat government has defended the Gujarat police accused inside and outside the court."

Vrinda Grover said that there is no evidence of Ishrat Jahan's relationship with any terrorist activity.

He said, "The order to release the employees of Gujarat Police justifies this encounter. It should be understood that the one whom the state considers its enemy or criminal can be killed and this should worry all of us." Shamima Kausar will challenge this order of release."
