Information Technology Act, 2000

Cyber ​​pornography is neither banned nor legalized under the IT Act, 2000. The IT Act prohibits the production and distribution of cyber pornography, but does not prohibit the viewing or downloading of pornographic material if it is not child pornography.

Section 67 of the Information Technology Act, 2000 makes the following acts punishable with imprisonment up to 3 years and fine up to Rs 5 lakh. Section 67A of the Information Technology Act provides for publication, transmission and transmission and publication of any material containing explicit sexual act or conduct which may be punishable with imprisonment of either description for a term which may extend to 5 years and with fine which may extend to Rs 10 lakh.
