Contempt petition in SC

Ground Report | New Delhi: Contempt petition in SC; A contempt petition has been filed in the Supreme Court against Prime Minister Narendra Modi and Union Home Minister Amit Shah. A lawyer has accused PM Modi and Amit Shah of 'willful refusal to comply with the directions of the Supreme Court in the matter of appointment of Rakesh Asthana as Delhi Police Commissioner.

The name of these lawyers is Mohanlal Sharma and they had also filed a petition demanding the constitution of a committee headed by the Special Investigation Team in the Pegasus espionage case.

Mohanlal Sharma has alleged that the appointment of Rakesh Asthana is in clear violation of the Supreme Court's order that all vacancies should be first reported to the Union Public Service Commission (UPSC) and there is a possibility of fewer than six months of working days left. In this situation, no officer should be made DGP.

The lawyer's PIL has claimed that PM Modi and Home Minister Amit Shah have lost their constitutional right to continue in office after violating the Supreme Court's directions. It has been requested in the petition that this matter should be investigated by a bench of at least five judges of the Supreme Court or else a constitutional crisis may arise and people's faith in the country may end. The Aam Aadmi Party government of Delhi is also opposing the appointment of Asthana. A few days ago, the Union Home Ministry had issued an order appointing Rakesh Asthana as the Commissioner of Delhi Police. This was his fifth appointment. That too only four days before his retirement.

Rakesh Asthana has been appointed to five different posts in a span of just three years. It is considered unexpected in the circles of administrative service. Asthana has worked as a special director in the CBI at one time. During this, he came into the limelight due to a dispute with CBI Director Alok Verma.

Asthana, who studied at Jawaharlal Nehru University (JNU), is considered one of the close officials of Prime Minister Narendra Modi and Amit Shah. When the Narendra Modi government was formed at the center, Rakesh Asthana of Gujarat cadre was called from Gujarat to Delhi along with 20 other top officers.

Rakesh Asthana has investigated important cases in his career so far, which are considered special in terms of current political equations. Such as investigation of the Godhra incident, fodder scam, Ahmedabad bomb blast, and investigation against Asaram Bapu.
